General conditions

These terms and conditions lay down the rights, obligations and liabilities between the Buyer (hereinafter referred to as the Buyer) and www.inflate24.com (hereinafter referred to as the Seller) as the Buyer purchases goods from www.inflate24.com . The transaction shall be deemed to have been concluded as of the moment when the Buyer, having added items to the shopping cart of the online shop, provided all the necessary details and paid (opted to pay) the Seller the specified amount, receives order (purchase) confirmation from the Seller via the specified email address and/or an SMS. Once the Buyer has placed the order, the Buyer shall be deemed to have read and unconditionally accepted these Terms and Conditions.

Rights and Obligations of the Buyer

In accordance with these Terms and Conditions and the legislation of the Republic of Lithuania, the Buyer shall have the right to purchase goods in the online shop. The Buyer is obliged to accept the goods and services ordered. If the Buyer chooses to have the goods delivered to the address specified, the Buyer must be present at the destination place at the time specified and accept the goods ordered. If the goods are to be accepted by someone other than the Buyer, when providing the delivery details, the Buyer must specify the details of the person who will accept the goods. In the event of any changes to the details on the Buyer‘s account, the Buyer must update all the necessary information. The Buyer shall have the right to return or exchange the Goods in accordance with these Terms and Conditions . In the event of any attempts from the Buyer to interfere with the operation or stable functioning of the online shop, the Seller may, without prior notice, restrict, suspend (terminate) the Buyer’s access to the online shop.

Rights and Obligations of the Seller

The Seller shall have the right to suspend the operation of the online store for a temporary or indefinite period without prior notice. The Seller shall undertake to create conditions for the Buyer to make proper use of the services provided by the online store. The Seller shall undertake to arrange delivery of the goods ordered by the Buyer to the address indicated by the Buyer. In the event of important circumstances where the Seller is unable to deliver the goods ordered to the Buyer, the Seller shall undertake to offer the Buyer a similar product or to change the delivery date, and in the event of the Buyer’s refusal to do so, to refund the payment by the Buyer within 3 business days. The Seller shall have the right to cancel the order placed by the Buyer after 3 business days without prior notice if the Buyer fails to pay for the order within the specified time or fails to provide the Seller with any additional information required for the proper execution of the order. The Seller shall have the right to cancel (block) the account of the Buyer if incomplete, false or misleading data is provided.

Payment Terms and Conditions

The Buyer shall pay for the goods via one of the methods chosen at the time of placing the order. The order shall only be executed and the delivery period shall be calculated after the Seller confirms the purchase via the email sent to the address provided by the Buyer.

Delivery of Goods

Goods are delivered throughout Lithuania, Latvia, Estonia, Poland, Germany by courier services. Shipping takes up to 7 days. Upon receipt of the consignment, the Buyer must carry out visual inspection of the consignment by checking the quantities, quality and range of goods. If the consignment is damaged, the Buyer shall note this information in the delivery documentation (bill of lading). If the Goods are accepted and the delivery note is signed without any notes, it shall be deemed that the consignment has not been damaged and has been properly delivered. The delivery price shall be specified in the order placed by the Buyer and in section Delivery and Returns. Unless agreed otherwise, the Goods shall be delivered to the first door of the building without loading/carrying/installation services. In the event of any obstacles impeding the access of the vehicle to the premises, the goods shall be unloaded at the nearest point where vehicle access is possible. Terms of delivery shall be specified in the order. The Buyer agrees that in exceptional circumstances the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller’s control. If such is the case, the Seller shall undertake to contact the Buyer immediately to agree of the terms of delivery. The Seller shall be exempted from any liability for the breach of the terms of delivery of the goods if the goods are not delivered to the Buyer or are not delivered within the time limits specified due to the Buyer’s fault or due to circumstances beyond the Seller’s control.

Returns and Exchanges

Returns of the goods purchased in the online store shall be made in accordance with the provisions of Articles 6.22810 to 6.22811 of the Civil Code of the Republic of Lithuania. The Buyer shall have the right to withdraw from the distance contract or a contract concluded outside the premises of the store within fourteen days (from the receipt of the goods), without giving any reason and without incurring any costs other than those provided for in Article 6.22811 of the Code, with the exception of certain exceptions specified in paragraph 2 of the Code. The Buyer may exercise the right of return provided that the goods have not been used, are not damaged and have not lost their merchantable appearance. The goods shall be returned in full. The Buyer shall be responsible for the complete assembly and packaging of the goods. If the set of goods not complete and properly packed, the Seller or its representative may refuse to accept the goods returned. Changes to the appearance of the goods or packaging thereof which were necessary to inspect the goods shall not be deemed to be a material change to the appearance of the goods. The Buyer shall return the goods which are not satisfactory to the Buyer using its own transport or pay the return costs. The cost of returning the goods shall not be reimbursed. If the Buyer prefers, the goods returned may be exchanged for a similar product of a different color, dimensions etc. In this case, the Buyer shall undertake to pay for the delivery of the goods and to pay (recover) the difference in price between the goods. Having decided to terminate the contract and notified the Seller, the Buyer shall lose the right to use the goods from the date of the notification. The date and time of dispatch of the notice shall be determined according the time of dispatch of the notice by the Buyer. If it is established that the goods have been consumed (used) after the date of dispatch of the notification, the Seller shall be entitled to refuse to terminate the contract. If the goods purchased did not meet the quality requirements, the Seller shall undertake to replace the goods of inadequate quality with the goods of suitable quality, to reduce the price of the goods accordingly or to refund the money paid for the goods and their delivery within 7 days from the date of the request. The goods must be returned in the original packaging of the goods and the parcel. The Buyer must also provide the original invoice for the goods and a completed and signed return form stating the reason for the return.

Final Provisions

Any disagreements arising out of the implementation of these Terms and Conditions shall be settled by way of negotiations. In the event of failure to reach an agreement, all disputes shall be settled in accordance with the procedures laid down in the legislation. Amendments or changes to these Terms and Conditions shall enter into force from the date of their publication, i.e. from the date they are posted on the online store. If the Buyer continues to use the services provided by the online store after the amendment of the Terms and Conditions, the Buyer shall be deemed to have accepted the new version of the Terms and Conditions as amended and supplemented. These Terms and Conditions do not limit the Buyer’s rights under the legislation of the Republic of Lithuania, including the rights in case of purchase of the goods or services of inadequate quality.
